1. Acceptance of Terms

By accessing or using the Classic Cream e-Bakery website, you confirm you’ve read, understood, and agree to these Terms & Conditions  and our Privacy Policy. If you don’t accept them, please stop using the site immediately.

2. Definitions

We/Us/Our – Classic Cream Bakery Ltd.

You/User/Customer – Anyone interacting with the Website or ordering products

Service(s) – Includes browsing, ordering, subscribing, delivery, Wellness and lifestyles and account management

Eligibility 

You must be at least 18 years old and legally capable of entering a binding contract to use our Services.

3. Account Registration & Security

3.1 Optional Accounts

Customers can choose to shop as a guest or register an account. Registered users can:

• Manage orders and subscriptions

• Save addresses and payment methods

• Access personalized dashboards

3.2 Account Security

You're responsible for maintaining the confidentiality of your login credentials. Notify us immediately if you suspect any unauthorized account use.

4. Orders & Payment

4.1 Order Acceptance

Orders (one-time or subscription) are processed subject to availability. If we cannot fulfill an order, we will reschedule the delivery or refund your payment in full.

4.2 Payment Methods

We accept secure payments via providers like Paystack. Full payment is required at checkout, and we do not store full card details.    The Company is not responsible for payment processor outages beyond its reasonable control.

4.3 Payment Processing and Liability

All payments on this website are processed through Paystack, a third-party payment service provider. We do not process, store, or have access to users’ payment details.

We are not liable for any payment failure, delay, reversal, duplication, or error arising from Paystack’s systems, network issues, or financial institutions. Transactions are only deemed completed upon successful payment confirmation by Paystack.

In the event of a payment dispute, users must provide valid proof of payment. Any investigation, refund, or reversal will be handled in accordance with Paystack’s policies and our applicable refund policy.

4.4  Pricing & Stock

We reserve the right to modify prices and stock availability at any time, and orders are only valid upon final confirmation.

5. Subscription Service

5.1 Subscription Tiers & Duration

Each tier offers unique product access, free deliveries, and tiered discounts.

6. Modification

• Subscribers: Modify orders (Pause or cancel) up to 24 hours before delivery.

7. Promotions & Discounts

• Codes are valid only during their stated period.

• One code per order.

• No retroactive application to past orders.

• We reserve the right to modify or cancel promotions at any time.

8. Delivery

8.1 Time Windows

Morning: 8–11 AM

Afternoon: 12 Noon –3 PM

Evening: 4– 6 PM

8.2 Delivery Fees

₦1,000 flat for 2 loaves and free delivery above 3 loaves .

Subscribers may receive free deliveries per tier; extra deliveries incur ₦1,000.

8.3 Coverage

Deliveries are currently available only in Lagos. We plan to expand to other locations.

8.4 Instructions & Wait Time

Provide delivery notes at checkout. Drivers wait up to 10 minutes upon arrival; after that, orders are considered undelivered.

9. Undelivered Orders & Re-delivery

We will attempt to call you. If unreachable, the order returns to our hub. Redelivery incurs ₦1,000 or you can pick it up at the hub.

9.1 Wrong or Incomplete Address Dispute resolution.

Please double-check your delivery address before placing an order.

If the address provided is wrong, incomplete, or hard to locate, it counts as a customer-side error.

If this happens:

We’ll try to reach you immediately.

If the rider can’t complete the delivery because of the incorrect address, the order is marked as undeliverable.

You can request a redelivery, but standard delivery charges of 1,000 Naira will apply again.

Refunds or free redelivery won’t apply in this situation since the issue didn’t come from our end.

10. Refund Policy

We aim to ensure every order meets our quality and freshness standards. Refunds or replacements are available in certain cases, such as wrong, damaged, or missing items. Requests must be made within ( 1hour) of delivery and follow our refund process. (Refund policy).

11. Force Majeure

.We shall not be liable for delays or failure to perform resulting from events beyond our reasonable control, including but not limited to natural disasters, strikes, civil unrest, or governmental actions.. We'll inform you of any disruption

12. Intellectual Property

All site content (text, logos, images, designs) are owned by Classic Cream and are protected by law. Unauthorized use is prohibited.

13. Privacy & Cookies

We collect necessary data (like name, address, order history) to serve you. Cookies help enhance your experience. We do not share your info without consent - see our Privacy Policy for full details.

16. User Conduct

You agree not to misuse the site (e.g. uploading viruses, harassment, illegal use). Violations may result in access termination.

17. Termination

We reserve the right to suspend or terminate service for any violation of these Terms or any unlawful activity

18. Limitation of Liability & Disclaimers

• Delivery times and availability are estimates not guaranteed.

• Products may contain allergens; please review ingredients.

• Our liability is limited to the value of your order; indirect or consequential losses are not covered.

19. Indemnification

You agree to hold Classic Cream harmless for claims or losses arising from your use of the Website or violations of these Terms.

20. Amendments

We may update these Terms at any time by posting changes on our Website. Changes become effective immediately; please review periodically.

21. Severability & Waiver

If any term is invalidated, the rest remain effective. Failure to enforce a provision doesn’t waive our rights later.

22. Governing Law & Jurisdiction

These Terms are governed by the laws of the Federal Republic of Nigeria. Disputes will be handled exclusively by Nigerian courts.
